Who is the EB-5 Visa for?

An entrepreneur looking to relocate to the U.S. invests money in a project within the country, demonstrating the legality of the funds. The required investment amount depends on the location of the project:
  • Minimum of $800,000 when participating in a project located in a targeted employment area (TEA) or rural area. These areas are designated by the U.S. Immigration Service and are unrelated to any specific city or state. TEAs are typically present in almost every American city, often characterized by increased unemployment rates.
  • Minimum of $1,050,000 when participating in a project not located in the aforementioned areas.

What is a Regional center?

Regional Center is a state-licensed development entity that brings together stakeholders (developers, investors, banks, and other managing organizations) to fund investment projects under the EB-5 program for the development of the American economy.

Participating in the program through investment in Regional Center projects is a more reliable option than investing in one's own business. This is because the project receiving the investment is initially backed by the involvement of numerous reliable partners, all interested, like the investor, in the successful implementation of the project and the return of the invested funds. They carefully monitor the project at every stage, thereby preventing potential unfavorable developments.

  • 1_What is a Regional Center?
    Regional Centers are state-licensed private companies created to promote the growth of the U.S. economy through the EB-5 program. Typically, these centers oversee projects such as hotel construction, shopping centers, large residential complexes, and more.
  • 2_How much investment is required to participate in the EB-5 program?
    There are two options:
    1. A minimum investment of $800,000, provided the project is located in a high unemployment or rural area (these areas are determined by the Immigration Service and are not connected to any specific city or state. High unemployment areas are usually present in almost every American city);
    2. A minimum investment of $1,050,000 when participating in a project that is not located in a high unemployment or rural area.
  • 3_What are the investment conditions for Regional Center projects?
    In the case of investing in a Regional Center project, it is necessary to:
    • demonstrate the required investment amount ($800,000 or $1,050,000);
    • prove the legality of the origin and the path of movement (accumulation) of funds;
    • documentarily confirm the movement of funds from the investor's country to the United States;
    • the return of investments typically occurs within an average of 4-5 years.
    • The fulfillment of other requirements, such as job creation, preparation of an investment memorandum, drafting a business plan, and confirming the project's location in a high-unemployment area, is taken care of by the Regional Center.
  • 4_Is it possible to use borrowed funds as investments in the EB-5 program?
    Yes, it is possible. Bank loans or loans from legal or natural persons can be used as investments. According to a recent court decision, borrowed funds provided without collateral can also be used, significantly easing the investor's conditions for participation in the program (in case of providing collateral, the investor must prove the origin of funds for acquiring such collateral).
  • 5_How to confirm the legality of the source of invested funds?
    In the context of the EB-5 program, confirming the legality of the origin of invested funds means that the investor must demonstrate not only HOW they obtained the invested amount but also how they earned (or received) their initial capital. For example, it's not sufficient to merely sell a house for $1 million and then claim the proceeds from the sale of the house as the source of investment. The U.S. Citizenship and Immigration Services will want to know how the investor earned the money originally used to acquire that house. If an EB-5 investor received funds, let's say, from their parents as a gift or inheritance, they will need to demonstrate how their parents earned the money for the house.
  • 6_What is the return on investment in Regional Center projects?
    The return on investment in Regional Center investment projects typically depends on the specific project. In current projects, the return is 0.25% every quarter.
  • 7_What guarantees exist for the return of investments in case of EB-5 visa denial?
    The terms of the agreement with the Regional Center typically outline conditions for the return in the event of denial or early withdrawal of the investor's petition. The return of investments is guaranteed if the denial is related to a project issue. If the denial is due to the source of funds, we identify another investor to replace the one wishing to withdraw funds and proceed with the fund withdrawal.
  • 8_How much is required to file an EB-5 petition?
    From $100,000. The law states that the investor must invest or be in the process of investing. Therefore, an investor can file a petition with an amount less than the total sum. As owners of the Regional Center, we provide such opportunities. We can arrange a consultation for you with several attorneys whose primary focus is working with EB-5 projects, with whom we have been cooperating for decades.
